8. Acceptable Use and Messaging Compliance
Last Updated: October 19, 2026
8.1 Purpose and Scope
This Acceptable Use Policy, incorporated as Section 8 of this Agreement (the “Policy” or “AUP”), sets out the standards for lawful, responsible, and secure use of SMSBoosting’s messaging services, including its SMS platform, application programming interfaces (APIs), and related services (collectively, the “Services”).
This Policy applies to all customers, account holders, and any persons or organizations that access or use the Services through a customer account (collectively, “Customers”). Customers are responsible for the activities conducted through their accounts, including activities of employees, contractors, agents, and other authorized users.
This Section 8 is an integral part of this User Agreement and applies alongside the SMS Boosting User Code of Conduct. It supplements, and does not replace, the existing requirements of this Agreement. Section 1.1.5 continues to govern special provisions in separate service agreements. Customers must comply with this Policy when using the Services. The examples of prohibited conduct below are illustrative and do not limit the general obligation to use the Services lawfully and responsibly.
8.2 Prohibited Activities
Customers must not use, or permit others to use, the Services for unlawful, misleading, abusive, or harmful activities, including the following:
8.2.1 Fraud, Phishing, and Deception
• Sending messages that impersonate a bank, payment provider, government authority, business, individual, or other entity without authorization.
• Using deceptive messages, links, sender information, or landing pages to obtain passwords, one-time passwords (OTPs), payment details, identification documents, or other sensitive information.
• Promoting scams, fraudulent offers, fake prizes, false delivery notices, fraudulent investments, or other schemes intended to mislead recipients.
• Misrepresenting the identity of a sender, the origin or purpose of a message, or the nature of a product or service.
8.2.2 Unsolicited Messaging, Harassment, and Abuse
• Sending spam or unsolicited marketing messages in violation of applicable law or recipient consent requirements.
• Sending repeated, threatening, intimidating, discriminatory, or harassing messages.
• Continuing to send marketing messages to a recipient after a valid opt-out or other legally effective objection.
• Using purchased, scraped, or otherwise obtained contact lists without the rights, permissions, and lawful basis required for the intended messaging activity.
8.2.3 Illegal or Harmful Content
• Sending content that facilitates illegal activities, the exploitation or abuse of children, threats of violence, or other conduct prohibited by applicable law.
• Distributing malicious links, malware, or instructions intended to compromise devices, accounts, or networks.
• Infringing intellectual property, privacy, or other legal rights of third parties.
• Sending content restricted by applicable telecommunications rules, destination-country requirements, or mobile network operators without the necessary authorization.
8.2.4 Platform and Authentication Abuse
• Attempting to gain unauthorized access to accounts, systems, APIs, or telecommunications networks.
• Circumventing sending limits, security safeguards, abuse-prevention controls, or applicable network restrictions.
• Disrupting, overloading, probing, or interfering with the Services or connected systems.
• Using SMS verification or OTP messages to facilitate account takeover, credential theft, unauthorized registrations, or other deceptive authentication activities.
8.3 Anti-Fraud, Anti-Money Laundering, and Financial Crime
Customers must not use the Services to conduct, promote, enable, or facilitate fraud, money laundering, terrorist financing, sanctions evasion, or any other unlawful financial activity.
Prohibited uses include, without limitation, messages intended to solicit or coordinate fraudulent transfers, conceal the origin or ownership of criminal proceeds, induce payments through false representations, or direct recipients to unlawful financial schemes.
Customers operating in financial services, payments, digital assets, or other regulated sectors are responsible for determining and meeting the legal and regulatory requirements applicable to their activities, including any relevant licensing, customer due diligence, anti-money laundering, and sanctions obligations.
SMSBoosting may restrict or discontinue use of the Services where it reasonably suspects that messaging activity is connected to fraud or other unlawful financial conduct, subject to applicable law and contractual obligations. This Policy does not replace any separate regulatory compliance program that may be required of a Customer.
8.4 Recipient Consent and Opt-Out Requirements
Customers are responsible for establishing and maintaining a valid legal basis for contacting each recipient and obtaining consent where required by applicable law, regulation, or telecommunications rules.
For marketing and promotional messages, Customers must provide clear and accurate information about the sender and purpose of the communication, obtain any required prior consent, and offer and honor an effective opt-out method where required. Customers must promptly stop sending marketing messages to recipients who have validly opted out and must not use the Services to evade suppression lists or other lawful messaging preferences.
Transactional, notification, and authentication messages must be related to a legitimate purpose and sent only where authorized or otherwise permitted by applicable law. Classifying a message as transactional or as an OTP does not exempt a Customer from applicable privacy, consent, identity, or telecommunications requirements.
Customers are responsible for maintaining appropriate records of consent, permissions, and opt-out requests where required and for making such records available when reasonably necessary to investigate a compliance issue, subject to applicable law.
8.5 Sender Identity and Telecommunications Requirements
Customers must accurately identify themselves in their communications and must not use false, misleading, unauthorized, or deceptive sender names, Sender IDs, telephone numbers, or other sending identities.
Where required for a destination country, network, or messaging use case, Customers must obtain the necessary Sender ID registrations, approvals, licenses, or other permissions before sending messages. A sender identity that is permitted in one market may be unavailable, restricted, replaced, or subject to different requirements in another.
Customers must comply with applicable mobile network operator rules, messaging registration requirements, content restrictions, permitted sending hours, and other destination-specific conditions. Customers must not attempt to bypass carrier filtering, routing restrictions, or regulatory controls.
SMSBoosting may decline or restrict traffic that is inconsistent with applicable rules or network requirements. The availability or acceptance of a sending route does not constitute confirmation that any particular campaign, sender identity, or message content is legally compliant.
8.6 Legal Compliance and Data Responsibility
Customers must comply with all laws, regulations, governmental orders, and applicable industry and telecommunications requirements relevant to their use of the Services, including rules relating to privacy, data protection, electronic marketing, consumer protection, and financial crime.
Customers are responsible for the legality, accuracy, and content of their messages; the collection and use of recipient contact details; and their instructions to SMSBoosting. Customers must not submit personal data to the Services unless they have a lawful basis and any necessary authority to do so.
Customers must take reasonable steps to protect their account credentials, API keys, recipient data, and connected systems against unauthorized access or misuse. They must notify SMSBoosting promptly if they become aware of account compromise or material misuse affecting the Services.
Where third parties send messages on a Customer’s behalf through the Customer’s account or integration, the Customer remains responsible for ensuring that those activities comply with this Policy and applicable law.
8.7 Compliance Review and Enforcement
SMSBoosting may review suspected violations of this Policy based on complaints, available service information, carrier notifications, or other relevant information, in accordance with applicable law and its contractual commitments.
Where SMSBoosting reasonably identifies or suspects a violation, it may take proportionate measures, as appropriate to the circumstances, including requesting information or corrective action; rejecting, filtering, or restricting messages; limiting sending activity; temporarily suspending access; or terminating Services as permitted by the applicable agreement and law.
Where legally permitted and appropriate, SMSBoosting may cooperate with telecommunications providers, regulators, law enforcement, and other competent authorities in responding to suspected unlawful activity. Such cooperation is subject to applicable legal and data-protection requirements.
Customers must provide reasonable cooperation in investigating suspected misuse, including addressing complaints, preserving relevant records where legally required, and taking steps to prevent repeated violations. Any applicable fees, penalties, or other consequences arising from a violation are governed by the relevant service agreement and applicable law.
8.8 Reporting Abuse, Policy Updates, and Contact
Suspected spam, phishing, impersonation, fraudulent messaging, or other misuse of SMSBoosting Services may be reported to info@smsboosting.com with the subject line “Abuse Report.” Reports should include, where available, the message content, sender information, approximate date and time, destination country, and a description of the concern. Do not include passwords, OTPs, or other unnecessary sensitive information.
SMSBoosting may update this Policy from time to time to reflect changes in its Services, applicable legal requirements, or telecommunications rules. The current version will be made available on the SMSBoosting website. Any notice and effective-date requirements under applicable law or agreements will be observed.
